How do you see the future of peer review CHALLENGE- OFFICIAL RULES

The ‘How do you see the future of peer review’ Challenge (the “Challenge”) is a written competition in which entrants are asked to submit an original idea (the “Idea”) that will significantly improve or add to peer review as it exists in its various forms for academic journals.  Entrants are also asked to submit ideas related to valuing and rewarding reviewers. Eligible entries will be entered in prize draws.

Please read these rules (the “Official Rules”) before entering the Challenge. By entering the Challenge, you agree to be bound by the Official Rules, and all the decisions of the Sponsor, and represent that you satisfy all of the eligibility requirements set forth herein.

ELIGIBILITY

The Challenge is open to individuals aged twenty-one (21) years or older at the time of entry. The individual listed on the entry form will be the only person eligible to receive a prize, even if more than one person has contributed to the submitted Idea. Entrants may be subject to rules imposed by their employer/institution relative to their participation in competitions or promotions and should check with their employer/institution for any relevant policies. Entrants are responsible for determining if the Challenge is legal in their jurisdiction of residence. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. Directors, officers and employees of Elsevier Ltd (the “Sponsor”), its parents, subsidiaries and affiliates, web design, advertising and promotional agencies, the Challenge judges, and the immediate families and those living in the same household of the foregoing are not eligible to enter. Any Idea, entry form, comment or other participation that violates these Official Rules, applicable laws or regulations, or participant’s employer’s/institution’s policies, will be deemed ineligible.

IDEA ENTRY PERIOD

The Idea entry period for the Challenge commences on March 28, 2012 at 15.00.00 p.m. Central European Time (“CET”), and ends at 23:59:59 p.m. CET on May 7, 2012 (the “Idea Entry Period”).  Sponsor’s server is the official clock for the Challenge.  

REGISTRATION

All participants must register at the Challenge website at www.peerreviewfuture.com (the “Challenge Site”) either by submitting a completed Idea entry form during the Idea Entry Period or thereafter by submitting a completed Challenge Site registration form available just prior to the Commenting Period. Registering on the Challenge Site is the only means by which entrants may submit Ideas and post substantive comments regarding Finalists’ entries.

HOW TO ENTER

 

To submit an Idea (1) visit the Challenge Site during the Idea Entry Period, (2) click on the “Submit Idea” link, and (3) complete the Idea entry form providing all required information. Submission of the completed entry form will also register the entrant on the Challenge Site. The description of the Idea in the entry form must be sufficiently clear and detailed to allow the Sponsor to readily assess the purpose, content, and utility of the proposed Idea. Entries that are (i) submitted in any manner other than as specified; (ii) submitted before or after the Idea Entry Period; or (iii) incomplete or in any way not in compliance with these Official Rules will be deemed ineligible for entry into the prize draws and for consideration. Entrant’s proof of submission does not constitute proof of receipt by Sponsor.  Only entries submitted electronically through the Challenge Site in accordance with these Official Rules will be eligible for consideration.  All entries become the exclusive property of Sponsor and will not be acknowledged or returned.

REPRESENTATIONS AND WARRANTIES REGARDING SUBMISSION OF AN IDEA.

Ideas, entries, and Comments submitted must be the original work of the participant submitting them. By submitting your Idea, entry and/or Comment in the Challenge, you voluntarily forfeit all proprietary rights in the Idea, entry and/or Comment and convey full ownership to Sponsor. Ideas, entries and Comments submitted shall not: (i) violate the intellectual property rights (copyright, patent, trademark, etc.) of any third party; (ii) defame or invade the publicity or privacy rights of any person, living or deceased; (iii) be the subject of a patent or pending patent application; (iv) otherwise infringe upon any person’s or entity’s personal or proprietary rights or (v) constitutes your sole original work that has not been previously published, released or distributed. Entrants are responsible for ensuring that Sponsor may use, develop, build, or otherwise publish their Ideas, entries and/or Comments without the permission of any third party. Any entries found to be in violation of these provisions will be disqualified. Ideas, entries and comments must not be obscene, profane, or unsuitable for publication in Sponsor’s sole discretion, must not contain any advertising, promotion or other solicitation, or any third party brand name or trademark; and must not contain any virus, worm, Trojan horse, or other harmful code or component .

JUDGING CRITERIA / SELECTION OF FINALISTS

All Idea entries will be initially screened by Sponsor with regard to obvious intellectual property conflicts or any legal issues and whether they fall outside the target area of interest for the Challenge. All remaining eligible Idea entries will be evaluated by a panel of qualified judges (the “Panel”).

The Panel will select up to ten (10) Finalist entries by applying the following judging criteria: (i) Quality of idea, (ii) Innovation/Novelty, (iii) Feasibility/Application of implementation, and (iv) Scope of applicability of the Idea. The ten (10) Finalist entries will be posted on the Challenge Site on or about Tuesday, 12 June 2012. Sponsor reserves the right to select fewer than ten (10) Finalist entries if, in its sole discretion, Sponsor does not receive a sufficient number of eligible or qualified entries, or if Sponsor is otherwise unable to timely fill the Finalist slots for any reason. All decisions of the Panel are final and binding in all respects.

COMMENTING PERIODS

Beginning on or about June 12, 2012 at 12:00:01 am CET, until 23:59:59 p.m. CET on June 22, 2012, the Finalist entries will be posted on the Challenge Site for comment by registered users of the Challenge Site (the “Commenting Period”). Registered users of the Challenge Site are invited to provide feedback on how to make the ideas described in the Finalist entries better, more relevant, or more broadly applicable, etc.

SELECTION OF WINNERS

There are several ways to win a prize:

  1. Panel Prize Winner – One (1) winner will be chosen by the Panel from all eligible Finalist entries.  The panel winner will be notified on or about July 30th 2012.
  2. Runners Up Prize winners – Two (2) runners up winners will be chosen by the Panel from all eligible Finalist entries.  The runners up winners will be notified on or about July 30th 2012.
  3. Commenter Prize Winners – Five (5) winners will be randomly chosen by Sponsor from all eligible registered users of the Challenge Site who post a substantive comment addressing one or more of the judging criteria on a Finalist entry, as determined in Sponsor’s sole discretion on or about July 30, 2012.  Each registered user will receive only one (1) entry for commenting, regardless of the number of substantive comments posted or votes submitted by that user.

PRIZES

One (1) Panel Prize Winner will receive $5000 cash prize

Two (2) Runners up Prize Winners will receive a Samsung Galaxy Tab 10.1 WiFi, 16GB (ARV: $448).  Samsung® and Samsung Galaxy Tab® are registered trademarks of Samsung Electronics Co., Ltd. who does not sponsor, endorse, administer, or is associated with this Promotion.

Five (5) Commenter Prize Winners will receive a Amazon® gift card (ARV: $50).  Amazon® is registered trademark of Amazon.com LLC who does not sponsor, endorse, administer, or is associated with this Promotion.

Total approximate retail value of all prizes in this Challenge: $6194

NOTICE TO WINNERS

Potential winners will be notified via e-mail using the e-mail address provided in the Challenge Site registration within ten (10) days of selection.  All potential winners must sign and return to Sponsor a Declaration of Eligibility and Liability/Publicity Release within 14 days of notification in order to claim the prize. If a winner:(i) is determined to be ineligible; (ii) cannot be contacted (for example, if the notice is returned as undeliverable); (iii) fails to return the completed Declaration of Eligibility and Liability/Publicity Release within 14 days of notification; or (iv) declines or waives the prize, or cannot or fails to accept the prize for any reason, then the prize will be forfeited and an alternate winner will be selected based upon the judging criteria in the case of the Panel Prize, and in a random drawing from among remaining eligible entries in the case of both the Contributor Prize and Commenter Prizes. Limit one prize per person/registered user/e-mail address.  Prizes will be awarded via mail to the name and address provided in the claim forms within 6 to 8 weeks following confirmation.

All prizes are non-transferable.  Cash will not be awarded in lieu of a prize, but Sponsor reserves the right to substitute a prize of equal or greater value in its sole discretion.  Prizes must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.  Winners shall bear sole responsibility for fulfilling any tax obligations associated with receipt and/or use of prize.  Panel Prize Winners will be issued an IRS Form 1099 for the value of the prize.  Sponsor is not responsible for lost, late, misdirected, mutilated or postage due mail or e-mail. Winning Idea entries will be posted on the Challenge Site on or about 15 August 2012, or as soon as the winners have been confirmed according to the process herein.

RIGHT TO USE ENTRIES AND PERSONAL INFORMATION

By submitting an Idea and/or Comment in this Challenge, entrants grant Sponsor a non-exclusive, irrevocable, transferable, royalty-free, perpetual, worldwide right and license to reproduce, publish, display, edit and otherwise use the submitted Idea and/or Comment, and entrant’s full name and city and state/province/country of residence, photograph, likeness, and voice, online and in print or any other media for purposes of editorials, exhibition, advertising, marketing publicity and promotion of the Challenge and Sponsor’s publications and products, without attribution, compensation, permission or further notification to the entrant, unless prohibited by law.   Sponsor may post, publish, display, use, reproduce, distribute, edit, translate, exploit, and create derivative works from the Ideas, the entries (including any visual materials), and any Comments for any commercial or non-commercial purposes in any manner and in any medium now known or hereafter devised throughout the world in perpetuity without restriction and without further obligation to entrants or any other party.  Entrant agrees not to instigate, support, maintain or authorize any action or lawsuit against Sponsor and/or its affiliates, or any of their employees, officers, directors, or agents, on the ground that any use or development of their Ideas, entries or Comments infringes any of their rights as creators of such Ideas, entries, and Comments.  Entrant hereby forever waives and relinquishes all so-called “moral rights (droit moral)” now or hereafter recognized in the Ideas, entries and Comments.

DISCLAIMER/LIMITATION OF LIABILITY

Notwithstanding anything to the contrary contained in these Official Rules or elsewhere, Sponsor makes available the Challenge, the Challenge Site, and any prizes on an “as is” basis and disclaims all warranties, including any warranties of merchantability and fitness for a particular purpose in connection therewith. Sponsor and its parents, subsidiaries, affiliates, agents, professional advisors, advertising and promotional agencies, and directors, officers, and employees thereof, shall not have any obligation, liability or responsibility for: (i) lost, late, incomplete, illegible, unintelligible, damaged, garbled, or misdirected entries, comments, votes, prize claims, notifications, or other communications; (ii) inaccurate entry information, whether caused by participant or by any of the equipment or programming associated with the Challenge; (iii) any errors or malfunctions that may occur; (iv) any condition caused by events beyond Sponsor’s control that may cause the Challenge to be delayed, disrupted or corrupted; (v) any error in any materials associated with the Challenge; and (vi) any damages or losses of any kind resulting from participation in the Challenge, accessing, transmitting, uploading or downloading data in connection with the Challenge, or acceptance, possession or use of any prize. Any use of robotic, automatic, macro, programmed or like entry or voting methods is strictly prohibited and will result in the disqualification of any entrant or registered user using such methods and the voiding of any votes generated by such methods, in Sponsor’s sole discretion.  Sponsor, in its sole discretion, further reserves the right to cancel, terminate, suspend or modify the Challenge if the Challenge cannot be completed as planned because of infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.

RELEASE

BY ENTERING THE CHALLENGE REGISTERING ON THE CHALLENGE SITE, AND/OR SUBMITTING COMMENTS AND/OR VOTING ON FINALIST ENTRIES, PARTICIPANTS RELEASE AND HOLD HARMLESS SPONSOR AND ITS PARENTS, SUBSIDIARIES, AFFILIATES, AGENTS, PROFESSIONAL ADVISORS, ADVERTISING AND PROMOTIONAL AGENCIES, AND DIRECTORS, OFFICERS, AND EMPLOYEES THEREOF, FROM ANY AND ALL CLAIMS, INJURIES, LOSS, DAMAGE, EXPENSES, OR LIABILITIES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH THE CHALLENGE, PARTICIPATION IN THE CHALLENGE (INCLUDING PROVIDING COMMENTS AND VOTING), OR DELIVERY, MISDELIVERY, ACCEPTANCE, POSSESSION, AND USE OF, OR INABILITY TO USE, ANY PRIZE, TO THE EXTENT PERMITTED BY LAW. IN NO EVENT WILL SPONSOR BE LIABLE TO A PARTICIPANT FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF, OR IN CONNECTION WITH THE CHALLENGE, WHETHER OR NOT SPONSOR HAS BEEN ADVISED, HAD REASON TO KNOW, OR IN FACT KNEW OF THE POSSIBILITY OF SUCH DAMAGE.

GOVERNING LAW AND VENUE

The laws of the UK govern the Challenge and these Official Rules. Participants irrevocably consent to the exclusive jurisdiction of the courts of The UK with respect to any action or suit arising out of or pertaining to the Challenge and these Official Rules (except where local law requires).

RESERVATION OF RIGHTS

If for any reason, the Challenge is not capable of being run as planned, the Sponsor reserves the right in its sole discretion to change these Official Rules, disqualify any individual who tampers with the entry or voting process or operation of the Challenge Site, and to modify, suspend, cancel or terminate the Challenge. If the Challenge is terminated early, the Sponsor may select Finalists and winners based on the Ideas and Comments received prior to the termination date or take any other action in its sole discretion to carry out the letter and spirit of these Official Rules.

RULES

Participants agree to be bound by these Official Rules and the decisions of the Sponsor in regards to the Challenge. Any participant found to be acting in violation of these Official Rules may be disqualified in Sponsor’s sole discretion. In the event of a dispute regarding the identity of a winner, the winner will be the individual registered user named in the Challenge Site registration through which the Idea or Comment was submitted.
